DHS report calls out cities and counties for not cooperating with ICE

At the center of the claims is Travis County Sheriff Sally Hernandez announcing after President Donald Trump's inauguration in January that her jails would no longer comply with all federal immigration detainer requests.

Immigration and Customs Enforcement has listed Boulder County Jail as a law enforcement agency that won't honor immigration detainer requests made by the agency, but the Boulder County Sheriff's Office contends that immigration enforcement isn't its job and it doesn't want the job either. The governor has called for a statewide ban on so-called sanctuary cities that fail to fully cooperate with federal immigration authorities, and a DHS report released on Monday-the first of ongoing weekly reports-highlighted jurisdictions across the country that refused to honor immigration detainers.

The vast majority of the rejected detainers were in Texas' Travis County, home to the liberal-leaning city of Austin. Lehigh County detained the New Jersey man in 2008 for two days before ICE realized Galarza was not the man they were looking for.

"My understanding, what was told to us, is that one of the reasons that happened was because the meetings that had occurred between the (ICE) field office director and the sheriff didn't go very well", he said.

"That's new knowledge to me", Bryant responded. "ICE is notified when a person in our custody has a detainer - since January 2017, 99 inmates have been released to ICE's custody".

Local government leaders are speaking out after a federal judge revealed Austin was targeted in a recent Immigration and Customs Enforcement operation.

Stephen Yale-Loehr, a professor at Cornell University Law School, described the list as the Trump administration's way of pressuring cities and counties into complying with the detainers. By issuing a detainer, ICE is asking a local jurisdiction to hold a person for up to 48 hours past his release date, until a federal agent can look into the situation. These sanctuary jurisdictions include Philadelphia; Clark County, Nev.; Washington D.C.; Boston; Newark; New York City; Chicago; Milwaukee and all of Rhode Island's state prisons.

Snohomish County tied with Montgomery County, Iowa, as the fourth in the nation for having the highest number of ICE detainers issued to a regularly noncompliant jurisdiction.

The Trump administration says some American law enforcement agencies have failed to help the federal government detain undocumented immigrants. During a call with reporters Monday, senior DHS officials indicated that many county jails list the names of inmates in public databases, which can be used to identify people listed in the DHS report. The three cases reported involved people arrested in Bastrop County, who were transferred to Travis County, according to the sheriff. The report is created to highlight jurisdictions that do not cooperate with ICE detainers.

Hernandez's office on Monday sought to clarify the numbers in the report.

Colorado law enforcement agencies and cities are defending their decision to not aid federal agents looking to deport undocumented residents who have been charged or convicted with a crime.

Some ICE suspects released during that week had previous "notable criminal activity", according to a report with the list. "Clackamas County honored an ICE detainer and held Ms. Miranda-Olivares ultimately costing taxpayers in excess of $100,000".

The report lists jurisdictions as non-compliant that are now complying with federal law, including the City of New Orleans, the Conference of Mayors stated.
